Terms and Conditions: The Breakdown Man (Wigan)

1. Services Provided

The Breakdown Man (“we,” “us,” or “our”) provides vehicle recovery, roadside assistance, and transportation services. By requesting our services via phone, text, or website, you (the “Customer”) agree to these terms.

2. Quotations and Call-Out Fees

• Fixed Quotes: Quotes are based on the information provided by the Customer (vehicle make, model, location, and condition). We reserve the right to adjust the price if the situation differs from the description (e.g., the vehicle is stuck in a ditch, has locked wheels, or is a larger class than stated).
• Cancellations: Once our recovery vehicle has been dispatched, no refund is payable, even if the vehicle is started or recovered by other means before our arrival.

3. Payment Terms

• Immediate Payment: Unless otherwise agreed in writing, full payment is due upon arrival at the destination and before the vehicle is offloaded from the recovery truck.
• Methods: We accept Bank Transfer.
• Right of Lien: We reserve the right to retain possession of the vehicle (Legal Lien) until all outstanding recovery and storage charges are paid in full.

4. Access and Safety

• The Customer must ensure the vehicle is in a location accessible by a standard recovery truck.
• We reserve the right to refuse service if the environment is deemed unsafe for our driver or equipment, or if the Customer is abusive or under the influence of alcohol or drugs.

5. Liability and Damage

• Pre-existing Damage: We are not liable for any damage that existed prior to our arrival. A brief visual inspection may be conducted before loading.
• Mechanical Failure: We are not responsible for further mechanical or electrical failure that occurs during the standard loading, towing, or unloading process (e.g., snapped cables or gearbox issues on an already damaged car).
• Personal Effects: The Customer is responsible for removing all high-value personal items from the vehicle. We are not liable for loss or damage to items left inside.

6. Waiting Time

Our quotes include a standard 20-minute window for loading. If we are delayed by the Customer, the Police, or a third party, an additional Waiting Fee of £50 per 30 minutes may be applied.

7. Law and Jurisdiction

These terms are governed by the laws of England and Wales. Any disputes will be handled within the jurisdiction of the courts local to Wigan.
